Terms
The terms for using AreCapable.
Plain terms, describing what AreCapable actually is and what your organization is actually agreeing to.
Last updated 2026-07-23 — draft, pending legal review before these terms take effect.
Agreement
By accessing or using AreCapable, your organization agrees to these terms on behalf of everyone it invites to use the service. If you are an individual user, your access is authorized by your employer or organization, not by self-registration.
What AreCapable is
AreCapable helps organizations turn training into verified, evidence-based capability, distinct from mere completion. It provides course and curriculum delivery, on-the-job task tracking, and capability checks that examine how someone applies what they learned under real conditions.
Accounts
Accounts are created by your organization's administrators. Your organization is responsible for who it invites and what access it grants them.
Commercial terms
AreCapable is offered under a contract between your organization and us, priced by the number of people your organization needs to train and verify. See Pricing.
Acceptable use
Use AreCapable only for its intended purpose: training and verifying the people your organization is responsible for. Do not attempt to access another organization's data, interfere with the operation of the service, or use it to violate the rights of the people entered into it.
Your content
Anything your organization uploads — courses, documents, media — remains your organization's property. We process it only to provide the service, including any AI-assisted features your organization has explicitly enabled (see our Privacy Policy).
Suspension
If your organization's account falls out of good standing — for example, a lapsed payment — access can be suspended. Suspension affects the organization's ability to sign in; no individual employee is blamed or told the reason.
Disclaimers
AreCapable is provided as-is. We work to keep the service available and evidence-handling accurate, but we do not guarantee uninterrupted access, and AreCapable does not warrant any specific business outcome.
Limitation of liability
[Limitation-of-liability clause — to be finalized with legal counsel before this page is approved.]
Governing law
These terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Any dispute arising from these terms will be brought in the state or federal courts located in Houston, Texas.
Changes to these terms
We will update the date above whenever these terms change. Continued use of AreCapable after a change means your organization accepts the update.
